Nyong’o calls on Chief Justice to intervene in Baby Pendo murder case

Kisumu governor Peter Anyang Nyong’o has expressed his strong reservations against what he termed as delaying tactics, in the ongoing Baby Samantha Pendo murder case.

Pendo died after being hit by a police baton at her parents’ house in Nyalenda estate in 2017, when officers used force to quell post-election protests in the area.

Nyong’o in a press release on Friday acknowledged that 12 police officers linked to the murder have been taken to court, adding that the case is taking too long to start.

“On Thursday, I read with consternation media reports that the highly anticipated plea taking by the 12 officers failed to take place for the third time,” said the county chief.

The plea taking could not take place as scheduled reportedly because the judge who had been handling the case has been transferred.

“Without any prejudice, I wish to state that the reasons given for the aborted plea taking are not convincing and appear to be mere scapegoats,” Nyong’o said.

“We are appalled that people who are expected to investigate and bring to justice those who killed baby Pendo are mishandling this matter.”

The continued postponement of the case, the second term governor said, was unacceptable and blatant violation of Human Rights.

He appealed to the Chief Justice (CJ) Justice Martha Koome, to take up the matter and ensure the case progresses with the speed it deserves.

“Justice Koome should urgently investigate why such a high-profile case is being delayed on flimsy grounds, while the suspects are walking around freely and still in employment with the Kenya Police service,” Nyong’o stated.

The CJ, he added, must find out immediately whether someone or groups of people are sabotaging this case to protect some people.

Among the officers expected to take plea in the case, is former Kisumu County Police Commander Titus Yoma.
